Abstract

The legal landscape of gaming in India stands at a crossroads, marked by a delicate balance between the traditional framework established by the Public Gambling Act, 1867 (the PGA) and the evolving dynamics of online gaming. The applicability of the IT Rules to the gaming sector raises pertinent questions, given the historical autonomy granted to states in legislating on gambling matters. There is a lack of clear regulations and guidelines that cover all the different types of online games. It is important to note the distinction between skill-based games and games based purely on chance. This distinction affects whether these games are legal or not, how much tax they pay, and what rules they need to follow.
